World of Dance Xfinity Fan Favorite - Official Voting Rules

The following terms (the “Official Voting Rules”) govern the World of Dance Xfinity Fan Favorite Vote available to current Xfinity residential customers with Xfinity television service and an eligible Xfinity X1 set-top box (“Voters”) during certain episodes of World of Dance (the “Show”). For the avoidance of doubt, the Prize (as defined below) will be awarded to the one (1) act from the Show that receives the most votes during the Divisional Final Voting Window (as defined below); Voters will not be eligible for the Prize or any awards. Please note that these Official Voting Rules are subject to change at the sole discretion of NBCUniversal Media, LLC (“NBC”). Notification regarding any such change will be posted at Xfinity.com

1. How to Vote

To vote via the Xfinity X1 set-top box (“Xfinity X1 Voting”), you must have an eligible Xfinity X1 set-top box, Xfinity X1 remote, and an active Xfinity television service subscription that includes NBC (fees may apply). You can access the Xfinity X1 voting interface on your television during the Voting Window(s) (defined below) using any of the following two (2) methods.

  • First, if you are watching the Show during your regional time zone’s broadcast feed (or within 1 hour after), use your X1 remote and press the info button when prompted on the screen (you will see a graphic in the top right corner of the screen that indicates that voting is open and that directs you to press the info button (the “Xfinity X1 Vote Graphic”)). If no prompt is visible, pressing the info button will launch your available options. Choose “Vote” to activate the voting screen on your television.
  • Second, you can use the voice commands, “Vote World of Dance” or “Vote for World of Dance” via your X1 remote during the voting window. These voice commands should activate the voting interface on your television.

Once you have arrived at the Xfinity X1 voting interface, use your Xfinity X1 remote to select an act and confirm your vote. Once you have clicked the “Confirm” button, your vote will be submitted and counted as valid (subject to the limitations below) and you will be directed to a “Thanks for voting” panel. Subject to the limitations below, you may vote for each act up to ten (10) times per X1 set top box during each Voting Window.

Information collected from Xfinity X1 Voting is subject to the Comcast Customer Privacy Notice (located at http://www.xfinity.com/Corporate/Customers/Policies/CustomerPrivacy).

Xfinity X1 Voting is open to viewers located in areas within the fifty (50) United States, including the District of Columbia, where Xfinity television service and Xfinity X1 set-top boxes are available (collectively, “Geographic Area”) who are thirteen (13) years of age or older and current Xfinity residential customers with Xfinity television service and an eligible Xfinity X1 set-top box. Voting Method Limits

NBC reserves the right to change the abovementioned limits on the number of votes that may be made via Xfinity X1 Voting in NBC’s sole discretion. The Administrators (defined below) reserve the right, in their sole discretion, to reject votes cast by any individual who does not abide by these Official Voting Rules or who tampers with the voting process or acts in a disruptive or unsportsmanlike manner or takes any other actions that they do not deem appropriate. Please note that certain voting limits and restrictions may not be enforceable as written due to limitations on the Administrators’ ability to prevent and track certain voting misuses, such as limitations on the ability to deduplicate votes submitted by one user via multiple accounts or by more methods than allowable under these Official Voting Rules.

2. Voting Rounds

Voters may vote using Xfinity X1 Voting in the following voting rounds:

2.1 Round 1

During the first round of voting (“Round 1”), Voters can vote using Xfinity X1 Voting in each of the four (4) Round 1 Duel Voting Windows (as defined in section 4.1 below). During each such Duel Voting Window, ten (10) acts (all from the same division) will be eligible for Xfinity X1 Voting. The four (4) acts that receive the most votes from each Duel Voting Window will advance to Round 2. If there is a tie for fourth position among two or more acts, Administrators (as defined below) may allow all tied acts to advance to Round 2 (contingent on the number of acts that can be displayed on the X1 voting interface).

2.2 Round 2

During the second round of voting (“Round 2”), Voters can vote using Xfinity X1 Voting in each of the two (2) Round 2 Cut Voting Windows (as defined in section 4.2 below). During each such Cut Voting Window, eight (8) acts will be eligible for Xfinity X1 Voting (or more in the event of a tie in Round 1). The acts will be paired in Round 2 as follows:

April 14, 2019 Cut Voting Window: Round 1 winners of the March 17, 2019 Duel Voting Window (Upper Division) and the Round 1 winners of the March 24, 2019 Duel Voting Window (Junior Team Division)

April 21, 2019 Cut Voting Window: Round 1 winners of the March 31, 2019 Duel Voting Window (Junior Division) and the Round 1 winners of the April 7, 2019 Duel Voting Window (Upper Team Division)

The one (1) act from each division that receives the most votes during each Cut Voting Window will advance to Round 3 (for a total of four (4) acts). If there is a tie for first place among two or more acts in any division, Administrators (as defined below) may allow all tied acts to advance to Round 3 (contingent on the number of acts that can be displayed on the X1 voting interface).

2.3 Round 3

During the third round of voting (“Round 3”), Voters can vote using Xfinity X1 Voting in the Divisional Final Voting Window (as defined in section 4.3 below). During the Round 3 Divisional Final Voting Window, four (4) acts will be eligible for Xfinity X1 Voting (or more in the event of a tie in Round 2). The one (1) act that receives the most votes during the Divisional Final Voting Window will be the winner (“Winner”) of the World of Dance Xfinity Fan Favorite Vote and receive the Prize (as defined below). If there is a tie for first place among two or more acts, all such tied acts will be declared the Winners of the World of Dance Xfinity Fan Favorite Vote.

2.4 Voting Resets Each Round

For the sake of clarity, vote totals will reset to zero at the start of each round. No votes from earlier rounds will be counted in later rounds (i.e., no Round 1 votes will be considered in determining which act has the highest vote count in Round 2).

3. Prize

The Winner will receive the following prize (the “Prize”): (1) the opportunity for the Winner to join the “World of Dance Experience” for one day (to be chosen by World of Dance Tour, Inc. in its sole discretion) on Jennifer Lopez’s “It’s My Party” tour (the “Appearance”); and (2) if Winner does not live within a reasonable driving distance to the Appearance, accommodations and roundtrip airfare from a major commercial airport closest to Winner’s residence to a major commercial airport in or near the city where the Appearance will take place (the “Trip”). The Prize will be provided by World of Dance Tour, Inc. (“Prize Sponsor”). The Appearance is conditioned on the negotiation and execution of a written agreement between the Winner and the Prize Sponsor relating to the Winner’s participation in the Appearance. If Winner (and if an act, any member of winning act) is a minor, Winner must be accompanied on the Trip by a parent or legal guardian who is twenty-one (21) years of age or older as of the Trip (“Guardian”). Guardian’s roundtrip airfare may be paid by Prize Sponsor at Prize Sponsor’s sole discretion. Prize Sponsor will determine all details of the Prize in its sole discretion. Prize Sponsor reserves the right to substitute Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Prize is unclaimed within a reasonable time after notification from Prize Sponsor, as determined by Prize Sponsor in its sole discretion, or Winner fails to execute the proposed agreement between Winner and the Prize Sponsor relating to the Winner’s participation in the Appearance, the Prize may be forfeited. Each member of the winning act who receives the Prize (or their parent or legal guardian if a minor) is personally responsible for all city, state, federal and any other tax obligations and any other fees and monetary obligations due on any monetary or non-monetary prizes or awards received in connection with the World of Dance Xfinity Fan Favorite Vote. Prize Sponsor, at its sole discretion, may deduct, withhold or require payment of any such applicable taxes before awarding the Prize. All such recipients agree to hold the Prize Sponsor, NBC, and Comcast Corporation harmless from any and all damages, losses, and penalties each may incur in the event that any recipient should fail to pay any taxes that may be due with respect to the applicable prize.

Winner must be able to travel between June 7, 2019 and July 26, 2019 (or on such other dates designated by Prize Sponsor). The Trip awarded to the Winner must be taken within dates provided by the Prize Sponsor or the Prize will be forfeited. Travel arrangements must be made through Prize Sponsor’s agent, on a carrier of Prize Sponsor’s choice. Certain travel restrictions and blackout dates may apply. Prize Sponsor has the right in its sole discretion to substitute air transportation for ground transportation depending on Winner’s place of residence. Winner must have valid travel documents (e.g., valid government issued photo ID and/or passport) prior to departure, and failure to do so will result in forfeiture of Prize. Prize Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates. Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. Prize Sponsor is not liable for any expenses incurred as a consequence of flight cancellation/delay. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. All travel and lodging will be at the risk of Winner. Winner is solely responsible for all expenses and costs associated with acceptance and/or use of Prize not specifically stated herein as being awarded, including, without limitation any and all taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize, travel insurance, ground transportation, security and airport fees, taxes, insurance, gasoline, meals, gratuities, and souvenirs. Prize Sponsor shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize, and is not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of Trip and Appearance are subject to change. Trip and Appearance are subject to cancellation. Elements of the Prize may be provided by an entity other than Prize Sponsor.

4. Voting Windows

Voting by Xfinity X1 Voting is available during multiple voting windows (“Voting Window(s)”). In the event of Show postponement, cancelation or other unforeseen circumstances, additional Voting Windows may be added and the below Voting Windows may be changed as determined and announced by Administrators in their sole discretion.

4.1 Duel Voting Window(s)

On March 17, 2019, March 24, 2019, March 31, 2019, and April 7, 2019, during the specific regional time zone broadcast feed of the Show and for 1 hour after (the “Duel Voting Window(s)”), Voters can cast votes via Xfinity X1 Voting within the following times:

5. Voting Requirements

To vote via Xfinity X1 Voting, you must be a current Xfinity residential customer with Xfinity television service, an eligible Xfinity X1 set-top box, Xfinity X1 remote, and an active Xfinity television service subscription that includes NBC (fees may apply).

6. Disclaimers

NBC and Comcast Corporation, and each of their respective direct or indirect parents, subsidiaries, related and affiliated entities and persons, and each of their respective agents, officers, directors, employees, managers, members, contractors, and their respective successors, licensees and assigns, and any other entity involved in the development, administration, promotion, or implementation of Xfinity X1 Voting and these Official Voting Rules (collectively, the “Administrators”) are not responsible for and shall not be liable for: difficulties, failures or malfunctions of computers, phones (including wireless phones/handsets) tablets and/or other devices, phone lines or telephone systems or other communications malfunctions; cellular equipment towers, telephone systems or wireless services; interrupted or unavailable networks, applications or servers; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission, communication or report; traffic congestion or for any technical or other problem which may cause the voting to be disrupted or corrupted.

If for any reason the voting is not capable of being executed as planned, or if there is an infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical or reporting failures, or if any other causes beyond the control of Administrators corrupt or affect the administration, security, fairness, integrity, or proper conduct of this voting, the Administrators reserve the right, in their sole discretion, to take any action they deem appropriate or to withdraw the transmission of any vote, but are in no way obligated to do so. Furthermore, the Administrators may, but are not obligated to, permanently disqualify from any voting any person Administrators believe has intentionally violated these Official Voting Rules, and terminate or suspend voting at any point and declare the vote results for any Voting Window based on the votes up to that point, if it appears that the voting process has been so distorted by hacking, failures, errors or other interference that the results would not reflect actual valid votes should the voting continue. In the event of technical or reporting difficulties with Xfinity X1 Voting including, but not limited to, Internet service interruptions, Administrators, in their sole discretion, reserve the right to review the votes for accuracy and to take any action they deem appropriate, including, without limitation, voiding all votes cast during the time period in which such technical or reporting difficulties occurred, voiding the votes cast during the time period in which such technical or reporting difficulties occurred with such method, and/or removing such method of voting from the Show altogether and relying only on the other voting methods, but are in no way obligated to do so. In the event of technical or reporting difficulties with Xfinity X1 Voting lead to a result that the winner(s) or loser(s) of any Voting Period cannot be determined, Administrators reserve the right to have eliminations be determined by any method determined by NBC in their sole discretion. Administrators assume no responsibility for any injury or damage to participants or voters or to any person's computer or other property relating to or resulting from entering or downloading materials, applications or software in connection with this vote, or otherwise participating in this voting. Administrators are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription or reporting of voting information, errors in any promotional or marketing materials, for any human or electronic error, or for votes or reports that are stolen, misdirected, garbled, delayed by computer transmissions, lost, or late. By participating, each individual agrees to release and hold the Administrators harmless against any and all claims and liabilities of any kind arising in whole or in part, directly or indirectly, out of such individual’s participation in the voting. Administrators will take commercially reasonable steps where practicable to prevent voting outside of the Geographic Area; however, some votes cast outside of the Geographic Area may be counted. Administrators will also take commercially reasonable steps where practicable to enforce other voting limits and restrictions set forth in these Official Voting Rules; however, some limits and restrictions may not be enforceable as written due to limitations on the Administrators’ ability to prevent and track voting misuse, such as voting using multiple accounts or by more methods than allowable under these Official Voting Rules.

Caution: Any attempt by a voter or any other individual to deliberately damage any online service or website, tamper with the voting process, or otherwise undermine the legitimate operation of the voting is a violation of criminal and civil laws and should such an attempt be made, Administrators reserve the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.

7. Conditions for Voting

By voting, you are agreeing not to use any unofficial, third party services to cast votes on your behalf. Administrators reserve the right, but are not obligated, to disqualify, block or remove any votes from any individual who votes by any electronic, mechanical or automated means, or otherwise tampers with the vote process including, without limitation, offering prizes or other inducements to members of the public and/or using any websites or online forums designed to induce individuals or provide other incentives to vote, or for any other reason, as determined by Administrators in their sole discretion. All votes are subject to final verification by Administrators.

Administrators are not responsible for any damages to voters' device(s) that may occur from use of service. Administrators reserve the right, for any reason and in their sole discretion without any obligation, to modify, suspend or discontinue the voting service without prior notice.  

Administrators reserve the right to modify these Official Voting Rules, the Voting Windows, and the terms and conditions of this voting process at any time in their sole discretion.

8. Dispute Resolution

THESE OFFICIAL VOTING RULES, AND SUBMISSION OF YOUR VOTE, ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY'S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
